Two ‘rapists’ have had their convictions overturned after a court was shown a selfie of her smiling with her alleged attackers.
The two men, identified only as Mustafa, 27, and Selim, 38, had been found guilty of raping the woman in Turkey, and were expected to be jailed for 16 years at a sentencing hearing.
But their lawyers had their convictions thrown out after presenting the photo, which was taken on Mustafa’s phone the day after the incident.
The woman claimed the two men had raped her after an evening drinking together in the Osmangazi district in Turkey’s Bursa Province.
The morning after the incident, the woman told police: ‘I went with them because I have known them for many years. However I didn’t sleep with them intentionally.
‘They put me in the middle. Mustafa grabbed me by my arms while Selim raped me. Then two of them raped me at the same time. I cried. Then Selim brought me home.’
Both men were arrested and denied rape, but were found guilty and were awaiting sentencing.
However, a retrial has been ordered after lawyers Ertugrul Aslantas and Kutsal Tutku Kalezade produced the selfie of the three people in Selim’s car the next day.
The men have been released on bail, and a date has not yet been set for the new hearing.
